Subject outline
In this unit students will explore the application of human rights law in the domestic arena. The potential for the development of domestic human rights law is analysed. In the context of human rights charters and recent case studies, a series of legal practice issues are examined. These include standing, amicus curiae, procedural opportunities and requirements, use of strategic litigation, advocacy and the media and law reform. The role of lawyers, the judiciary, non government organisations and others engaged in direct service delivery is also analysed.
