Subject outline
In this subject, students will learn a basic overview of those areas of European Business Law that are most relevant for Australian and Oceanic businesses investing in the European Union (EU). More than 35 years of harmonisation and regulation within the EU have led to a significant convergence of the corporate laws of the Member States, yet only within a rather narrow scope. Considerable differences between the corporate laws of the Member States persist. The lack of harmonisation has been the cause of practical difficulties, leading to a number of important rulings by the European Court of Justice (ECJ). In addition, the European Commission has forwarded a number of initiatives and legal measures to overcome obstacles resulting from this lack of harmonisation. This subject will explore the impact of business entities laws on the business community.
