Subject outline

This unit will provide an advanced course of study and reflection contemporary national and international conflicts of law issues. In particular, the unit will identify and deeply analyse the effect that globalisation is having on a range of existing legal rules and regulatory regimes. The unit will consider whether globalization is rendering existing legal rules inadequate and in need of fundamental reappraisal. Topics for consideration will include judicial jurisdiction, jurisdiction in cyberspace, forum non convenience , international parallel proceedings (especially the increasing use of anti-suit injunctions), provisional and protective measures in international litigation, the recognition and enforcement of judgments and the Hague Choice of Court Convention.
