Subject outline

This subject will provide a broad overview of intellectual property litigation in the United States, with an emphasis on emerging and key issues being addressed by the courts and/or the legislature. The patent section will deal with such issues as patentability; business method patents; the requirements and desirability of prior notice of alleged infringement; preemptive actions before the federal courts; administrative strategies before the United States Patent and Trademark Office (PTO), including ex parte and inter partes reexamination; types of infringement; means plus function claims; false marking claims; pleading requirements; venue; extraterritorial reach of U.S. patent law; jurisdiction over "foreign" individuals or entities—national contacts personal jurisdiction; infringement allegations; methods of patent invalidation, including prior art and inequitable conduct.
