Subject outline

Students in this subject examine inquisitorial law and practice in Australia. The focus of study is the coronial jurisdiction. Its contribution to justice, social policy and advancement of the public interest is examined and critically assessed. Using a comparative approach, other inquisitorial commissions and tribunals are examined. Jurisdictions studied may include Australia, Britain, Europe, Asia, Canada and the Pacific. Specific topics include theories and methods of fact investigation and analysis, legal reasoning and decision making. Issues of standing, procedural requirements, client interviewing and case management, advocacy and use of media may also be addressed.
