Subject outline
Contract Law A examines the foundational principles of the law of contract in Australia. Students will interrogate the common law presumptions of freedom of contract and equality of bargaining power and analyse the capacity of equity to ameliorate the effects of those presumptions. This subject considers the role of contract law as a transactional mechanism and as a method of allocation of risks and assesses the impact of the development of implied duties to cooperate and to act in good faith in the performance of contractual obligations.
