Subject outline

The subject explores the modern phenomenon of arbitration of investment disputes under bilateral and multilateral treaties. It compares the two main forms of investment arbitration, ICSID arbitration under the World Bank Convention of 1966 and non-ICSID arbitration, e.g. under the UNCITRAL Rules, which will be taken as representative. Major topics of the substantive and procedural law are covered, from commencement of the arbitration to annulment, review and enforcement. This subject will include a review of the relevant law and a case study for class discussion. The emphasis throughout will be on current, cutting-edge issues in a field where theory and practice often diverge and disagreements abound.
