Subject outline

This subject provides an introduction to basic principles of Australian criminal law. The principal agencies and procedures involved in State and Federal policing, investigation and prosecution of crime will be outlined. The role of prosecutors and defence counsel, as well as judges, will be briefly canvassed. Principles of criminal responsibility will be considered, as well as conditions that can negative responsibility (age, mental impairment and involuntariness). Mental states that can underpin criminal responsibility (intent, recklessness, negligence) and strict liability will be considered. The elements of the offences of murder, manslaughter, conduct endangering life and driving while intoxicated will be described and analysed.
