Subject outline
In this unit students will examine the nature of property and ownership; rights of common owners: concurrent estates, marital property, present estates and future interests, and the trust as a form of divided ownership; other than fee simple interests in property: public and private limitations on the use of land (interests in the land of another); easements, profits, licenses, covenants and servitudes; a summary of public land use controls (zoning and subdivision restrictions); real estate transactions: the real estate contact and the mortgage; constitutional issues associated with property: compulsory purchase, regulatory takings and land development conditions (5th and 14th Amendment).
