Subject outline
This subject explores intellectual property law in the sports and entertainment fields. The subject will provide an overview of intellectual property law: trademarks, copyrights, patents and trade secrets. Many professional sports teams identify themselves through trademarks and service marks. The subject will explore the many cases litigated in this area as well as addressing statutory issues. Copyright in both the sports and entertainment fields presents unique issues. In sports, the course will focus on the rights of players and teams at both the professional and amateur levels. Patent laws are also present in the sports field especially with regard to equipment use in tennis, golf, baseball and football. Amateur sports leagues also have interests in protecting their intellectual property rights. Trade secrets in both the sports and entertainment industries deal with issues such as the covenant not to compete, confidentiality agreements and non-disclosure agreements.
