Subject outline
The process of developing the United Nations Convention on the rights of People with Disabilities (CRPD) and its subsequent adoption by the United Nations General Assembly has raised the profile of the disability as a human rights issue on the international and national law and policy agendas. This subject explores and considers some aspects of Australia disability law and policy in the context of this recent international development. The first part of the subject establishes the theoretical and legal framework based on human rights principles. The framework is then tested by an examination of particular case studies, which may vary from year to year, for example, supported decision making: inclusive education; the right to family life; access to justice employment; migration; social participation. Throughout the study period the role of law and policy in promoting and protecting the rights of people with disabilities is evaluated: areas requiring reform are identified; and strategies for the change considered.
