Common Law and the Australian Legal System introduces students to Australia's fundamental legal institutions, the methods of Australian lawyers and sources of law in Australia. Students develop essential skills for studying law including case analysis, legal problem solving, legal research and written and oral communication. The subject examines what is law and explores both adversarial and non-adversarial approaches to dispute resolution. Topics include the history of law making in Australia, the doctrine of precedent and the origins of legal reasoning, indigenous law and its relationship with the common law, the Australian legal profession and selected principles of Australian public, private and procedural law.
