Subject outline
Environmental regulation has expanded from a domestic phenomenon to one that has both global impacts and global participants. In this course, we will determine when the international community is likely to act with respect to environmental problems, what legal processes it uses to address these problems, and how to assess the success of these regulatory interventions. Within this more general framework of International Environmental Law, specific attention will be paid to the role of the World Trade Organisation (WTO) in environmental protection. Conflicts between trade and environmental protection have given rise to challenges under the WTO agreements and actions before the WTO#s Appellate Body. This course will study these cases in detail, including trade bans for environmental purposes. We will also look at the application of the "precautionary principle" in WTO law; intellectual property protection and biodiversity; food security and poverty-reduction.
