Subject outline
In this unit, students will examine the essential conceptual and substantive characteristics of the European civil law relating to trade and commerce using the common law as a reference point. First, students will consider the historical and conceptual origins and development of the civil law in Europe. Secondly, students will overview the law of contract, including voluntarily assumed obligations and consumer protection, and commercial and company law in Europe with a focus on the legal systems of France, Germany, and the European Community as sub-families within the family of the European civil law. Thirdly, students will study theories of convergence and divergence within the civil law and common law divide. The unit is taught offshore at Universidad Pontificia Comillas in Madrid, Spain. Accordingly, students will have the opportunity to contextualise their studies in this unit through their exposure to the socio-economic reality of a European civil law country.
