Subject outline
In this subject students will be introduced to basic principles of private international law and their operation within the Australian legal system. Private International Law (also referred to as Conflict of Laws) is a body of rules applied to legal disputes where one or more of the elements are connected with a foreign jurisdiction. The rules are applied to ascertain the applicable law (choice of law); the forum for the resolution (jurisdiction); and enforcement mechanisms and rules (recognition and enforcement of foreign judgments). Private International Law principles are applied to private disputes including family, contract, property and tort.
