Update on the La Trobe University Enterprise Bargaining Negotiations

Negotiations for a variation to the current La Trobe University Enterprise Agreement (which covers the majority of academic and general staff) commenced in July, with the NTEU tabling its log of claims. The current Agreement reached its nominal expiry date at the end of June 2008 and staff received their most recent salary increase of 4% under the Enterprise Agreement on 5 July 2008. An administrative pay increase of 2% took effect from 4 July 2009.

  • Meeting on 15 May for NTEU to provide University with information relevant to claims regarding research only fixed term contract staff.
  • Negotiation meeting on 5 May. University provided responses on several clauses (PDF 8KB). These included responding to unions’ request to remove the impact of HEWWRS from the enterprise agreement. The University proposed re-instigating clauses from the 2001 enterprise agreement in a number of areas, including probation, general staff classification and dispute settling procedures.
April 2009
  • Union requested (PDF 137KB) the immediate recommencement of negotiation meetings (2 April)
  • University responded (PDF 256KB) (6 April) that time was required to review and consider the Union’s full claim – the document contains several new and complex claims, and is approximately 188 pages long.
  • Meeting on 9 April where Union to take the University bargaining team through the document.  NTEU repeated earlier request for a meeting with Vice Chancellor and other senior staff to provide information on the research only fixed term contract staff claim.  The University has proposed this meeting for 15 May.
  • The NTEU and University agreed to hold the next negotiation meeting on 5 May, to cover non controversial clauses and minor drafting issues.  The parties also agreed that substantive negotiations would resume in the week commencing 18 May, with a view to quickly concluding an agreement.

January 2009
  • Negotiation on clauses provided by the Union continued on 22 and 30 January.
  • The University requested (on 30 January) that the NTEU provide a complete draft of all remaining proposed clauses to the agreement, so that all matters could be considered and a total response could be provided by the University.  A number of cost related items were “parked” at earlier negotiations as these could not be considered by the University until the full details of the claim were provided by the Union.  This would then enable the University to evaluate the claim from an overall perspective, including its total cost.
December 2008
  • Research Planning Day on 1 December with NTEU and senior staff responsible for research to consider the Union’s claim.
  • Union provided University with proposed clauses relating to Casual and Sessional Staff (4 December).
  • Negotiation on clauses provided by the Union continued on 4 December.
November 2008
  • Union provided University with proposed clauses relating to General Staff Classification (revised) (24 November).
  • Negotiation on clauses provided by the Union continued on 14 and 27 November.
October 2008
  • Union provided University with proposed clauses relating to:
    • Modes of Employment (30 October)
    • Contract Research Staff (30 October)
  • Negotiation on clauses provided by the Union continued at meetings on 9 and 30 October.
September 2008
  • Union provided University with proposed clauses relating to:
    • Leave Provisions (9 September)
    • General Staff Classification (12 September)
    • Termination & Discipline (16 September)
  • University provided Union with proposed clause amendments sought by the University for the total agreement (17 September)
  • Negotiation on clauses provided by the Union commenced at meeting on 18 September.

  • University and Union agreed in principle the structure of the new EBA.
16 July 2008
  • Negotiation meetings commenced.
  • Negotiation principles agreed.
  • University requested the Unions to provide details of its log of claims in the form of proposed clauses.
