Infringement of copyright

Copyright is infringed when one or more of the copyright owner’s exclusive rights is exercised in relation to a 'substantial part' of the work or other subject matter without permission.

'Substantial part' is not defined in the Act, but in deciding whether or not an act amounts to an infringement, courts have placed a greater emphasis on the quality of what is used rather than the quantity. There are exceptions.

The Copyright Act 1968 states exceptions to the infringement of copyright in the following categories:

Literary, dramatic, musical or artistic work

Audio-visual
